Chill & Heat Air Conditioning LLC is a California licensed HVAC contractor providing residential and light commercial heating, ventilation, and air conditioning services, including installation, replacement, repair, maintenance, ductwork, and indoor air quality solutions. All work is performed in accordance with applicable state and local codes.

2. Use of Website

This website is for informational and scheduling purposes only. You agree not to:

Estimates:

Are valid for a limited time
Are subject to material pricing and availability
Do not include unforeseen code upgrades unless stated

4. Permits & Code Compliance

Permits will be obtained when required unless otherwise noted in writing.

If existing systems must be upgraded to meet current code requirements, additional charges may apply and will be approved before work continues.

5. Scheduling & Access

Customers agree to:

Provide clear and safe access to all work areas
Secure pets
Ensure someone 18 years or older is present to authorize work

Missed appointments or cancellations without reasonable notice may result in a service fee.

6. Payment Terms

Payment is due upon completion of service unless otherwise agreed in writing.

For installation projects:

A deposit is required to schedule and order equipment
Progress payments may be required for multi-day projects

We accept cash, check, and major credit/debit cards.

Financing is available on approved credit through third-party providers.

Failure to make payment may result in:

Late fees
Suspension of warranty service
Collection activity
Legal action

Customer agrees to pay all reasonable collection and legal costs incurred.

7. Service Call & Minimum Charges

A service call fee applies and includes travel time and system evaluation.

All service visits are subject to a minimum labor charge.

Additional charges may apply for:

After-hours service
Weekend or holiday service
Locations outside our primary service area

8. Equipment & Special Orders

Equipment and materials ordered specifically for a project:

May require a non-refundable deposit
Are non-returnable once delivered or installed

Storage fees may apply if installation is delayed due to customer scheduling.

9. Warranties

Manufacturer warranties apply to equipment and parts.

Labor warranties are limited and will be stated in writing.

Warranties do not cover:

Lack of maintenance
Misuse or neglect
Unauthorized modifications or repairs
Electrical issues, power surges, or voltage problems
Acts of nature or external damage
Pre-existing conditions

Warranty service may be denied on accounts with outstanding balances.

10. Maintenance Requirements

Routine maintenance is required to maintain system performance and may be required to keep manufacturer warranties valid.

11. Property Protection & Jobsite Conditions

We take reasonable precautions to protect your property and will clean the work area upon completion.

We are not responsible for:

Pre-existing damage
Drywall cracking due to normal vibration
Cosmetic issues unless caused by negligence

The Company reserves the right to stop work if unsafe conditions are present.

12. Customer-Provided Equipment

We do not warranty customer-supplied equipment or materials.

Additional labor charges may apply for installation of non-standard or incompatible equipment.

13. Limitation of Liability

To the maximum extent permitted by law, Chill & Heat Air Conditioning LLC shall not be liable for:

Indirect, incidental, or consequential damages
Loss of use, loss of income, or loss of business
Delays caused by material shortages, weather, permitting, utility interruptions, or other events beyond our control

Our total liability shall not exceed the amount paid for the specific service performed.

14. Force Majeure

We are not responsible for delays or failure to perform due to events beyond our control, including but not limited to extreme weather, supply chain disruptions, labor shortages, acts of God, utility failures, or government actions.

15. Photos & Documentation

We may take photographs or video of equipment and work areas for documentation, warranty, training, and quality control. No personally identifiable information will be shared publicly without written consent.

16. Right to Refuse or Terminate Service

We reserve the right to refuse or discontinue service for:

Unsafe or hazardous conditions
Harassment or inappropriate behavior
Non-payment or repeated late payment
Work that violates code or safety standards

17. Cancellations & Returns

Services already performed are non-refundable.

Special-order equipment is non-refundable once ordered.

18. Governing Law

These Terms and Conditions shall be governed by the laws of the State of California.

19. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. The most current version will always be posted on our website.
